Appellate Advocacy and Litigation/Trial Support

The Powell Law Firm concentrates its practice on appellate advocacy and litigation/trial support services in all Florida and federal courts.  The firm handles cases arising from medical negligence, intentional torts, general negligence, breach of contract, insurance bad faith, wrongful death, products liability, maritime law, attorney-client privilege, criminal prosecutions and medical licensing disputes.

The Powell Law Firm handles Florida and federal civil, criminal, and constitutional writs and appeals. Brett Powell has handled appeals in every District Court in Florida, the Florida Supreme Court and the Eleventh Circuit Court of Appeals. Although the majority of our cases are referred to us by other attorneys, the firm accepts select cases directly from clients who need to prosecute or defend a civil or criminal appeal.

Trial Support

At the trial level, our work is designed to complement the efforts of trial counsel at no additional charge to the client. This work includes research into complex legal issues, drafting and arguing dispositive motions, ensuring proper preservation of the record, and filing petitions for extraordinary writs, as necessary. 

Civil Appeals

At the appellate level, our services include the management and prosecution of the entire case, including the preparation of motions, appellate briefs and the presentation of oral argument. Our representation begins with a thorough understanding of the findings of fact, identification of all legal issues, standards and burdens, and a determination as to whether appellate issues are preserved.  We thoroughly analyze and research the merits of all appellate issues before proceeding to the prosecution of the appeal.  We vigorously advocate our clients’ positions while maintaining the highest standards of professional ethics and integrity. 

Criminal Appeals

When the Powell Law Firm seeks to overturn a criminal conviction on any grounds, we undertake a comprehensive review of the entire court record in the case. Whether the appeal is taken to a state appellate court, the Florida Supreme Court or in the federal courts, the Powell Law Firm vigorously fights for its client’s legal rights while maintaining the highest standards of professional practice.
